Announcement of the 2022 Examination:

SSA will offer this year's examination to join the EDPNA program during the period of June 5, 2022, through June 10, 2022. This year, we will offer the examination through a remotely proctored online portal. The exam will be limited to three hours, and participants will have access to the online Electronic Code of Federal Regulations for reference.

The application period will run from February 1st to February 28th each calendar year. The application will be available for download during this time. We will accept applications received or postmarked on or before February 28, 2022. We will return applications that are postmarked after this date without considering them.
  • Do not complete the location section on the application form SSA-1691.

CPS HR Consulting will reach out with complete details to candidates who are eligible to take the examination.

General Information

The rules for representation of claimants before the Social Security Administration (SSA) can be found in
206 [42 U.S.C. 406] of the Social Security Act (Act) and 20 CFR 404.1700 and 416.1500. Specifically, Section 206(e) of the Act and 20 CFR 404.1717 and 416.1517 provide the rules for the Eligible for Direct Payment Non-Attorney (EDPNA) program.

In order for non-attorneys representative to receive direct payment of fees authorized under Titles II and XVI of the Act, they must meet the following requirements:

  1. Complete an application and pay the application fee. Information about the application process can be found here.

  2. Have a bachelor's degree from an accredited institution of higher education or at least four years of relevant professional experience and either a high school diploma or General Education Development (GED) certificate. You can find information about the education or equivalent qualifications requirement here.

  3. Pass a written examination that the SSA writes and administers. This examination tests the applicant�s knowledge of the relevant provisions of the Act and the most recent developments in SSA and court decisions affecting Titles II and XVI of the Act.   4. Secure and maintain continuous professional liability insurance or equivalent insurance, which SSA determines to be adequate to protect claimants in the event of malpractice by the representative. You can find information about the liability insurance requirement here.

  5. Undergo a criminal background check to ensure the representative's fitness to practice before us. You can find information about the criminal background check here.

  6. Demonstrate ongoing completion of qualified courses of continuing education including education regarding ethics and professional conduct, which are designed to enhance professional knowledge in matters related to entitlement to, or eligibility for, benefits based on disability under titles II and XVI of the Act. Through the services of a private contractor, CPS HR Consulting, SSA determines if a non-attorney representative meets the aforementioned requirements to be eligible for direct payment of fees for his or her claimant representative services. After you pass the written examination, you must submit documentation to CPS HR Consulting as proof that you meet the education or equivalent qualifications and liability insurance requirements.

Once we have determined that you meet the requirements for eligibility for direct pay, CPS HR Consulting will issue you a Notice of Eligibility for direct pay. You must then submit a completed Form SSA-1699 (Registration for Appointed Representative Services and Direct Payment) to register with SSA on or after your official date of eligibility.

For changes in your mailing and email address, phone number, or name, you must contact CPS HR Consulting and your local field office. You can contact CPS HR Consulting to update your information through any of the following methods.

Specifically, for changes in your name, you must first fill out an application for a social security card (Form SS-5). You can get the form by visiting www.socialsecurity.gov on the Internet, any one of our offices, or by calling our toll-free number, 1-800-772-1213.

For changes in payment information, you must submit a completed Form SSA-1699 to SSA.
